How to stop this harassment

How to stop this harassment
One of the relatives work place, her boss make her to stay back till 12 pm and sometime 1.00 am. She never able to leave the office before 7.30 pm every day. Her office timing are 9.00 am to 6.10 pm. Please suggest how to stop this arrasement and where to complaint. Her boss is very arrogant and do not have any clemency. Plese help and also guide me how to stop this arrassment.

I assume that there is no discrimination of her as a woman. So this case will be exactly same if your relative were a male except for steps for safety of being a woman.
Although Factories Act 1948 section 66 does not allow women in night shift, many states laws allow such shifts.

But if state law does not permit it then till 10 pm women may work after getting permission from concerned authorities.

If night shifts are allowed then only this provision is available for safety of working women as per Vishaka Guidelines:

Quote:Employers need to provide conducive & appropriate work conditions for women staff in the view of : work, health, hygiene & leisure. In short there mustn’t be any conditions creating hostile environment towards working women staff and any conditions which could put women at an disadvantage position with regards to her career compared to other male employees of the company.

She should lodge a case against her boss and she can get him behind the bars only by complaining against him to higher authorities or in Police. She can also blame him for forcing her to wait even after the legal office timings.

I don't think the goal is to get the boss behind bars. the goal is to inform the boss/workplace of her rights. she should request a copy of the office's sexual harassment policy first. chances are there isn't one; so she should bring to the notice of HR or other similar designation of the Vishaka directions. All of this should be in writing.
