When Leave can be made Leave Without Pay?
Hi everyone! I am working as a faculty in a reputed autonomous private institute. They offer PG programs to mainly Civil Engineers and Architects. This institute has not been accrediated by AICTE nor UGC. Under which authority's purview such institutes fall? I have worked with different institutes and have 25 years of experience. During my entire service, I always have taken sanctioned leave and not faced any problem.

I have 5.5 day CL to my credit but when I have applied for 2 day casual leave our director sanctioned 1day leave as CL and made 1 day leave as leave without pay. He has not given any reason for doing so. Our leave rules state that employees can apply for 2 day casual leave at a time.

According to my understanding leave can be made without pay only when there is no leave balance to the credit of employee. Or leave cannot be sanctioned due to office exigencies.

In my case there was no office exigencies and he has sanctioned both days leave but 1 day CL and 1 day leave without pay. Can any director penalise employee when there is leave balance to the credit of employee? I need your advise in this matter.

There is no government regulation on the CL and each company may have different rule for CLs. So in your case it seems you can't take more than 1 CL at a time.

Secondly Paid Leave is covered under Factories Act, 1948. 1 leave in each 20 days.
