<br />
I find myself In am unexpected situation. <br />
I am an employee of a reputed pvt sector bank. <br />
<br />
After having a healthy pregnancy until 37 weeks suddenly on the next regular checkup it was found that the baby had no heartbeat anymore.  This was an iufd (in utero fetal death)  this was discovered on 37th week and 4 days. <br />
<br />
Thereafter the baby was delivered through normal delivery through pain induction. <br />
<br />
Please advise what would be my maternity leave eligibility. <br />
<br />
As per the provisions of the act, <br />
The definition indicates a still born child is also a child <br />
<br />
And hence my understanding is that I should be eligible for 26 weeks as per the current ammendment. <br />
<br />
Also the act specifies that a miscarriage is until the 26 th week of pregnancy. <br />

I am working in a private sector. Company announced the process shut down by August last week and issued re-deployment letter by 1st week of September with 2 months notice. There was issue neither with my performance nor with my behavior. Company couldn't redeploy me in any other process as I was 6 month pregnant by October and also the training duration for any new process was around 3 to 4 months because post training I might have to go a maternity leave which will have no effect on the training that they provide<br />
<br />
Company has agreed to give me only 3 months paid leaves that is from November 1st to January 31st 2017 however my due date is January 18th 2017. And also I will be removed from the system as they cannot keep me in payroll without salary. <br />
<br />
Is the action taken by my company is right?<br />
I had also requested them to put me in any team so that I can do any backend or admin related Job till my delivery however they denied stating they don't want to put me in stress by learning new things. However for me, being in a job is more important as i have other commitments. Hoping for a positive reply<br />

During this entire period my employer had not paid me, saying he is facing some financial business issue. On completion of my leaves for taking care of my baby i need more time, on which we mutually decided for my resignation. that time he was ok on it, and asked me to resign. but after my resignation, when i started doing follow up for my pending 3 months maternity leaves salary he straight away denied to pay that for the reason i am not joining back to him. please guide me, what provision do we have in law for may case.]]></description>

They are giving me 3 months of paid maternity leave but the salary will be given to me for those 3 months when I will join back and work for 80 days.<br />
That is if my maternity leave is from December to February then I will get the salary for these 3 months in May which is working for full 3 months after my maternity leave.<br />
Please help me, I need to know whether this is right or wrong as per maternity law. <br />

I delivered child on 8/1/15 and according to  BSNL training center rules I could not avail any type of leave for more than 10 days otherwise I had to undergo again  any new batch start after 1-2 years. Anyhow i had completed my training on 20/01/15 with availing 6 days Causal leaves.<br />
On 21/01/15, I got posting as TTA in ahmedabad with 2 years probation period.<br />
Now, am I eligible for maternity leave?<br />
Please suggest me only with strong written proof otherwise it is impossible to convince my admin section.<br />

			<description><![CDATA[hi,im working in esic mumbai since april 2012 as senior residant under three yr residency schme.in feb 2013 to aug 2013 i was on maternity leave( 180 days) by sactined order from medical superidadnt  n resumed duty after ml. bt in jan 2014,i got letter from admin stating that ml is 84 days n remaining days as EOL and asked for recovary, around 1.8 lakh.till now all are getting 180 days leave bt now suddenly admin got letter from gurgaon esic stating 84 days for SR .letter dated in 2011 to gourgaon n now here in mumbai recovary strated.i applied rti, rti replied contract n temporary r same rules,bt doesnt metion days,appled on it bt no reply n recovary strated from from monthly pay. i think there is no fault of me,hospital sactinoed 180 days so i was on leave otherwise i can join after 84 days. amount of recovary huge,please somebody guide what i should do next? where to applel? its mental n maternal harrsment case,how to oppose it/]]></description>

Application is put on hold because the Date of birth of my second son is prior to date of Medical Certificate submitted.<br />
<br />
1. Date of Birth of my Second Son - 27th Oct'08<br />
2. Date of Maternity Leave started - 08th Nov'08 to 03 May'09 (177 days)<br />
3. There were Diwali Holiday's in Education Department from 26th Oct'08 to 07th Nov'08. I Joined School on 07th Nov'08.<br />
4. Medical Certificate was submitted from 08th Nov'08 to 03rd May'09<br />
<br />
All the relevant documents are submitted to Department. But department put the ACP on hold by making a remark as mentioned below - <br />
<br />
"your service book is mentioned in dated 8.11.08 and your affidavit is declared in your second son date of birth is 27.10.08 .and service book sanction in maternity leave sanction 177 days. Your recovery is 9 days in recorded your service book so the candidate is deposit the recovery on 9 days. after a.c.p.is to be sanctioned. thanks"<br />

<br />
Request you to please suggest the way forward &amp; help me in providing me clarifications on below mentioned queries :<br />
<br />
1. Is the recovery of 9 days is as per rules <br />
2. Will this recovery be treated as "Service Break"<br />
3. Who will approve these leaves &amp; Which leaves to be approved<br />

			<description><![CDATA[I had applied for the post of Consultant (Doctor) in ESIC Hospital in 2008 got interviewed in 2009 and was offered job in  May 2010.Since I was pregnant and delivery was expected in September 2010 I requested for extension in joining, which was granted for three months and I was asked to join by 14 Aug 2010.Accordingly I joined on 12 August 2010 and applied for ML from 14 August to 13 Feb 2011.The leave was granted and later sanction order also issued by the Medical Superintendent of the Hospital.On my joining back I was paid the salary for the leave period.My probation completion order was  also issued in December 2013.<br />
Recently, during audit inspection ,it has been pointed out the no salary was due to me for the period of ML.Although the same has not been intimated to me officially, but unofficially I have come to know that the finance section is working out amount of recovery to be made from me for the salary paid during the ML period.<br />
Kindly let me know if the audit objection is correct and the salary is recoverable from me?If not which rules can I quote/refer to so that I can officially take up the issue with the finance section of the hospital.<br />

			<description><![CDATA[I am working with Public Ltd.co.from last 3yrs &amp; was on payroll from Apr12. I was on maternity leave from 26th nov 13 to 23rd feb 14 (90days) as per co's rule I have to resume duty on 24th feb. Therefore I resumed office for 1day &amp; apply for further 3mnths leave extension. But now they are not ready to give me extension for another 3mnths &amp; sanctioned leave only upto 18th march 14. My new born baby is just 2&amp;half mnths till 18th march &amp; my baby sitter will take care only after baby will complete 4mnths. I request my seniors but they are not ready at all, so now what can I do if I want to take another 2mnths leave. I am having 50PL balance and also ready for LWP. Shall I apply leave for medically unfit as I had an C-Section, if yes then when can I apply either on or before 18th march 14 as they extended leave only upto 18th march.<br />
I need help what can I do as I don't want to resign and worry about what will they take action if I have not join from 19th March 14.]]></description>

			<description><![CDATA[I have been selected as Inspector in Central Excise and Customs. I have to appear for its medical/physical exam within 20 days and joining will be around next month. Will being one month pregnant disqualify or delay my joining? <br />
1. Prior to joining there will be a medical test, will there be any problem if they find out I am one month pregnant?<br />
2. I intend to join as per schedule, work for 6 months and then take maternity leave and CCL. Will I be eligible?<br />
I understand that my probation will increase, just don't want delay in joining.]]></description>

I hv joined PSB in July as PO,at that time i was 6 months pregnant but i dint disclosed it as in medical certificate there was no such column at the time of joining.After 1 week of joining i started facing issue of preterm delivery due to which i have been recommended complete bed rest till delivery.<br />
now my due date is 1st nov...meanwhile i have put medical leave application twice in between this period .now i hv already taken leave for 3 months and 3 months are in balance but i need more leaves as due to complications i have to undergo ceasarean.Can i get more leaves.Also i am not gettin salary Am i not eligible for maternity benefits like medical reimbursement and salary.<br />

I am Lecturer in Maharashtra Govt engg college &amp; working since last 9 years. As my pregnancy was complicated, doctor suggested to take complete bed rest for the whole pregnancy period. I applied for Maternity leave (for 6 months) on 01-Apr-2013 when I was 3 months pregnant. I delivered baby on 19-Aug with C-section delivery. <br />
As my maternity leaves are getting over by 30-Sep, I want to extend my maternity leave for another 6 months to take care of my baby. <br />

I have gone through below post on your site (Maternity Leave Rules for Women Government Employees). But could not find much details in the artifacts referenced (Maternity Benefit Act, 1961 &amp; Maternity Benefit Amendment Act, 2008 ) <br />
