It is grossly illegal to ask for resignation at this stage.
Firstly you should send to her office a registered letter(with acknowledgment) to her office with medical certificate and leave application in normal way and also ask for medical advance as per maternity rules. Send the same by email too. Seems you've already sent an email. If they don't act in 10-15 days, call them that you're going to nearest labour commissioner. In such cases your nearest labour commissioner will redress your complaints In India, it is common for companies to pay regular bribe even to labour commissioner. In the worst case you can very easily take a stay order from court in India. Not only that, her company will not be able to fire her for quite some time if you go to court with genuine case. You should not compromise. Such companies must be taught a lesson. |
