Promotion during Maternity Leave
I am the employee of Central Govt. Body. I was promoted from Jr. Stenographer to Sr. Stenographer and the order to this effect was issued on 01.01.2009. I was blessed with the daughter on 14.11.2008. I was on maternity leave from 29.09.2008 to 26.03.2009 as per Central Government rule. I joined as Sr. Stenographer post on 27.03.2009 after availing six months maternity leave . Because of this reason the increment was not given to me w.e.f. 01.07.2009 but it was given to me w.e.f. 01.07.2010. Am I eligible for my annual increment w.e.f. 01.07.2009 instead of 01.07.2010.

RE: Promotion during Maternity Leave
It happened with one my relative too. Increment wasn't applied when due but only paid fully backdated when she joined. In short on your joining you should get all your dues of increment from 1.7.2009. This is injustice and it makes you unequal with that of male counterparts.

You must pursue it with full force. Secondly similar provision is there in maternity benefit act too though it does not apply in your case.

You need to point out this aberration with senior authorities.
